Are sex toys regulated?

Short answer. Most of this category is sold in the US as novelty goods rather than medical devices. That classification carries no material disclosure requirement, no ingredient labelling standard, and no enforcement of terms like medical grade, body safe, or hypoallergenic. Those phrases mean whatever the seller wants them to mean.
How the classification works
The FDA regulates medical devices, which are products intended to diagnose, treat, or affect the structure or function of the body for a medical purpose. A product marketed purely for pleasure does not meet that intended-use test, so it falls outside the medical device framework entirely.
What is left is general consumer product law, administered by the Consumer Product Safety Commission. That covers acute hazards like a product that catches fire or a battery that ruptures. It does not require anyone to tell you what polymer they used.
A handful of products in this space are regulated. Personal lubricants are typically medical devices and are subject to real requirements. Some devices marketed with therapeutic claims cross the line by their own marketing. The physical products themselves generally do not.
What that means in practice
- No requirement to state the material at all.
- No requirement that a stated material be accurate.
- No enforced definition of medical grade, body safe, hypoallergenic, or non-toxic.
- No ingredient list, no batch traceability, no material change notification.
- No agency you can report a mislabelled product to.
The practical consequence is a market where a $12 product and a $120 product make identical safety claims, and only one of them is telling the truth.
The phthalate gap
Several phthalate plasticizers are restricted in children's products in the US under the Consumer Product Safety Improvement Act. None of those restrictions apply to adult novelties, because the restriction is scoped to products intended for children.

How other markets handle it
The EU applies the General Product Safety framework and, more importantly for materials, REACH chemical restrictions. REACH restricts several plasticizers across consumer goods without a novelty carve-out, which means a product sold legally into the EU has cleared a bar the US version has not.
This is why manufacturers selling into both markets sometimes run two formulations, and why buying the EU-market version of a product is occasionally a genuine safety upgrade rather than a branding difference.
What to do about it
Since the regulatory floor is effectively absent, the only floor is the manufacturer's own standard, which means you are choosing a company as much as a product.
Look for a named polymer, a named cure system, and a named manufacturing location. A company that publishes all three is accepting accountability it is not legally required to accept, and that voluntary disclosure is the most reliable signal available in this market. Then buy non-porous. Platinum silicone, borosilicate glass, and 316L stainless steel remove most of the risk regardless of what any label claims, because their safety comes from the physical properties of the material rather than from anyone's honesty.
